A Study of Human Rights Violations in People with Mental Illness : Following the revision of the mental health Welfare Act, the National Human Rights Commission relied on Petitions

Abstract
This study looked petitions submitted to Korea¡¯s National Human Rights Commission following the revision of the Mental Health Welfare Act in 2016. The findings of the 2008 study to determine how the true content changed. We compared and analyzed violations of rights and measures in accordance with the rights to liberty, dignity, and equality based on the pilot research. The study found that the first violation of liberty of people with mental illnesses decreased by 9% when compared to before the law was changed. However, there were numerous cases of petitions that did not meet the protection standards. Second, violations of the dignity of people with mental illnesses increased by 12%, and there were numerous petitions about isolation and detention. Third the violation of equality of people with mental illnesses decreased by 4%, resulting in less insufficient continuous hospitalization screening in treatment. The number of privacy violations caused by CCTV, on the other hand, has not decreased. Based on these findings, a public forum for debate on more realistic human rights education and the standards of those obligated to protect was proposed. Furthermore, regulations to strengthen medical service providers¡¯ legal liability were proposed.
